Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Conquarto ("Service"), a tabletop wargaming campaign management platform operated by Conquarto Systems ("we", "us", or "our"). By creating an account or otherwise using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service you represent and warrant that you meet these eligibility requirements.

2. Accounts and Authentication

The Service uses Discord OAuth exclusively for account creation and authentication. You must have a valid Discord account to use Conquarto. You are responsible for maintaining the security of your Discord account and for all activity that occurs under your Conquarto account. Notify us immediately at [email protected] if you suspect unauthorised access.

3. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
Upload, post, or transmit content that is defamatory, obscene, harassing, or otherwise objectionable.
Attempt to gain unauthorised access to any part of the Service or its infrastructure.
Interfere with or disrupt the integrity or performance of the Service.
Scrape, crawl, or systematically download data from the Service without our express written consent.
Use the Service to transmit spam or unsolicited commercial messages.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate any account that violates these rules at our sole discretion, without prior notice.

4. User Content

You retain ownership of all content you submit to the Service, including campaign names, descriptions, battle records, map data, and faction details ("User Content"). By submitting User Content you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and process that content solely for the purpose of operating and improving the Service.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe any third-party intellectual property rights.

5. Subscriptions and Payments

Certain features of the Service may require a paid subscription ("Subscription"). Subscriptions are billed in advance on a recurring basis (monthly or annually as selected). By subscribing you authorise us to charge your chosen payment method on each billing date.

All fees are stated in your local currency where supported, otherwise in US Dollars, and are exclusive of any applicable taxes. You are responsible for all taxes assessed on your use of the Service.

You may cancel your Subscription at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time unless required by applicable law. We reserve the right to change Subscription pricing on 30 days' notice. Your continued use of the Service after the price change constitutes acceptance of the new price.

6. Free Tier and Trial Periods

We may offer a free tier or trial period at our discretion. Free tier features may be modified or discontinued at any time. At the end of a trial period your account will revert to the free tier unless you have activated a paid Subscription.

7. Intellectual Property

The Service and its original content, features, and functionality — excluding User Content — are and remain the exclusive property of Conquarto Systems and its licensors. Our trademarks, trade dress, and logos may not be used without our prior written permission. You may not copy, modify, distribute, or create derivative works from any part of the Service without express written consent.

8. Privacy

Our handling of your personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to the collection and use of your data as described therein.

9. Third-Party Services

The Service integrates with Discord for authentication and may link to other third-party websites or services. We are not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is governed solely by the terms of those services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CONQUARTO SYSTEMS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED US DOLLARS (USD 100) OR THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Conquarto Systems and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.

You may delete your account at any time via your account settings. On account deletion we will remove your personal data in accordance with our Privacy Policy; your campaigns and associated data may be retained in anonymised form to preserve the integrity of shared campaign history.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

Before initiating any formal proceeding you agree to attempt to resolve the dispute informally by contacting us at [email protected] and giving us 30 days to respond.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, by sending a notification to your registered email address or Discord account. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
